Avoid Repossession

What Are Your Options

Despite all the dire economic news, all is not lost.  Many people have suffered the loss of a job or a drastic reduction in their wages.  Still others have gotten deeper in debt and perhaps find themselves on the verge of having property repossessed or even worse, bankruptcy.  Though not a cure-all, there are some steps you can take help avoid repossession.

Your first move should be to not run at the first sign of financial challenges that may be coming your way.  Keep a strict monthly budget and when you notice that you are starting to pay out more than you take in, scan all areas of monthly expenditures to see if there is a specific area of spending that you can reduce and still make your car payment, for example.

Long before you have to frantically go about avoiding repossession, call your creditor at the first sign of trouble.  Many lenders, believe it or not, appreciate a proactive borrower and instead of a hard line approach, may show some flexibility and understanding for your situation.  It is not uncommon for lenders, if called in advance, to waive late penalties and to hold off reporting any late payment activity to the credit bureaus.  Avoid damaging your credit and avoid car repossession at the same time.

Even if, despite your best efforts, you find it increasingly impossible to make monthly payments to creditors, you might be able to work out new loan terms with your lenders.  Remember, most lenders would much rather do what they can to keep you in your car or home, than to incur the costs associated with repossession.

With respect to your home, you can avoid repossession or bank foreclosure by using the same responsible and proactive tactics you use with your auto lender.  With some of the recent legislation that is aimed at keeping homeowners in their homes, a reconfiguring of the terms of your loan is a real possibility.   Be as persistent with your bank and your bank is with you when you fall behind in your monthly payments.  Banks will usually do what they can to avoid adjusting the terms of your loan, but if faced with loan mitigation or foreclosure, they may opt for the former rather than the latter.

Knowing how to avoid car repossession and home foreclosure can help you buy time while you get back on your feet.  Again, you make the first move and attack the situation head on.  Just because you have had some tough times does not render you powerless.  Don't let things go down the road toward bankruptcy.  Act boldly and confidently before it’s to late.

Failure to Pay Results in Mortgage Repossession

By James Copper
Possibly one of the worst things a homeowner can go through is having their principal residence repossessed by the holder of the mortgage for failure to maintain adequate monthly payments. When a home mortgage is issued, a signed contract is made between the borrower and the lender, stipulating monthly payment amounts as well as when the lender may take steps for mortgage repossession for failure to make the payments.
